Terms of use

1. General Provisions

1.1. These Terms of Use (hereinafter – the “Terms”) govern the access to and use of the CARENTIFY online platform (hereinafter – the “Platform”), which provides an information technology service enabling interaction between vehicle owners (hereinafter – “Owners”) and users seeking to rent vehicles (hereinafter – “Renters”).

1.2. The Platform is a software-as-a-service (SaaS) solution, categorized under “Web Search Portals, Libraries, Archives, and Other Information Services” (NAICS 519200). The Platform is not a rental company, does not provide vehicle rental services, and does not act as a party to rental agreements concluded between Owners and Renters.

1.3. The Platform:

  • does not assume any risks related to the rental of vehicles;
  • does not verify, control, or guarantee the technical condition, roadworthiness, completeness, or legal compliance of vehicles;
  • does not provide delivery, handover, or return services of vehicles;
  • does not insure vehicles and bears no responsibility for insurance coverage, damages, or losses.

1.4. All contractual relationships regarding vehicle rental are concluded directly between Owners and Renters. Rental terms (including but not limited to pricing, deposits, cancellation penalties, and other obligations) are determined solely by the Owners and are not set or controlled by the Platform.

1.5. The Platform’s revenue is derived exclusively from:

  • service fees charged on transactions facilitated through the Platform,
  • and/or additional marketing and advertising services provided to users.

1.6. Payments on the Platform are processed via third-party payment service providers (such as Stripe, LiqPay) or in cash at the vehicle handover, if agreed upon by the parties. The Platform is not a payment operator and bears no responsibility for the operation of third-party payment services.

1.7. The Platform’s customer support serves solely as a communication channel for forwarding information and claims between the parties. The Platform is not an arbitrator, does not resolve disputes, and does not impose binding decisions on Owners or Renters.

1.8. By using the Platform, the user acknowledges that they have read, understood, and accepted these Terms and agree to comply with them.

 

2. User Registration and Account

2.1. In order to access the services of the Platform, users must create a personal account (hereinafter – the “Account”).

2.2. Eligibility requirements:

  • The user must be of legal age and have full legal capacity under applicable law.
  • Renters must hold a valid driver’s license recognized in the jurisdiction where the vehicle will be operated.
  • Owners must provide proof of ownership or other legal authorization to list and rent out the vehicle.

2.3. Verification:

  • The Platform may request identity verification, driver’s license validation, and/or vehicle documentation verification.
  • The Platform may use third-party services for verification.
  • The Platform reserves the right to deny, suspend, or terminate an Account if verification fails or fraudulent activity is suspected.

2.4. Account security:

  • Users are responsible for maintaining the confidentiality of their login credentials.
  • Any activity carried out through the Account shall be deemed performed by the Account holder.
  • The Platform shall not be liable for losses resulting from unauthorized access to an Account due to user negligence.

2.5. Account use restrictions:

  • The Account may only be used by the registered individual or legal entity.
  • The Account may not be transferred, sold, or shared with third parties.
  • Multiple Accounts for the same user are prohibited unless expressly permitted by the Platform.

2.6. Account suspension or termination:

  • The Platform reserves the right to suspend or terminate Accounts that violate these Terms, applicable law, or third-party rights.
  • The Platform may also suspend or terminate Accounts in cases of suspected fraud, misuse, or failure to provide required documentation.

2.7. By creating an Account, the user confirms that the information provided is accurate, complete, and up to date, and agrees to promptly update any changes.

 

3. Vehicle Listing

3.1. Owners may list vehicles on the Platform for rental purposes by creating a vehicle profile (hereinafter – the “Listing”).

3.2. Vehicle requirements:

  • The vehicle must be in roadworthy condition, meet applicable safety and technical standards, and have all legally required documents (e.g., registration, inspection, insurance where required by law).
  • The Owner must have legal rights to list and rent out the vehicle, either as the legal owner or as a duly authorized representative.
  • Vehicles that are stolen, unregistered, unsafe, or otherwise not compliant with law are strictly prohibited.

3.3. Listing content:

  • Owners are responsible for providing accurate and complete information about the vehicle, including description, photographs, rental price, deposit (if any), mileage limits, fuel policy, and other conditions.
  • Misleading, false, or incomplete information is prohibited.
  • The Platform may review Listings for compliance but does not guarantee their accuracy or completeness.

3.4. Pricing and terms:

  • Owners independently set rental prices, deposits, cancellation penalties, and other rental conditions.
  • The Platform does not control or determine vehicle pricing or Owner policies.
  • Owners are responsible for updating their Listing to reflect current terms.

3.5. Vehicle condition and handover:

  • Owners must provide the vehicle in good working condition, clean, and with the necessary documents.
  • Owners must ensure the vehicle complies with all legal requirements at the time of handover.
  • Any existing damages or defects must be disclosed to the Renter before the rental begins.

3.6. Prohibited Listings:

  • Vehicles used for illegal activities, unsafe modifications, or vehicles under legal restrictions (e.g., liens, seizure) cannot be listed.
  • The Platform reserves the right to remove Listings that violate these Terms, applicable law, or third-party rights.

3.7. By creating a Listing, the Owner confirms that the information provided is truthful, accurate, and up to date, and assumes full responsibility for the listed vehicle.

 

4. Rental Terms

4.1. Eligibility of Renters:

  • Renters must hold a valid driver’s license recognized in the jurisdiction where the vehicle will be operated.
  • Renters must meet any additional eligibility criteria set by the Owner (e.g., minimum age, driving experience, clean driving record).
  • The Platform does not guarantee Renter eligibility and is not responsible for verification beyond the information provided.

4.2. Booking process:

  • Rentals are initiated when a Renter submits a booking request through the Platform and the Owner confirms the request.
  • The rental agreement is deemed concluded directly between the Owner and the Renter upon confirmation.
  • The Platform serves only as an intermediary technology provider and is not a contracting party.

4.3. Rental duration and return:

  • The rental period is determined by the terms specified in the Listing and agreed upon by the parties.
  • Renters must return the vehicle on time, in the agreed condition, and with the agreed fuel level and mileage (if applicable).
  • Late returns may result in additional fees as determined by the Owner.

4.4. Use of vehicle:

  • Renters must operate the vehicle in compliance with applicable laws, traffic regulations, and Owner’s conditions.
  • Renters are prohibited from:
    • allowing third parties to operate the vehicle without the Owner’s consent,
    • using the vehicle for illegal activities, off-road driving (unless permitted), competitions, or commercial purposes not authorized by the Owner,
    • taking the vehicle outside the permitted geographic area.

4.5. Vehicle condition:

  • The Renter must inspect the vehicle before accepting it and report any visible damages to the Owner.
  • The Renter must return the vehicle in substantially the same condition, accounting for normal wear and tear.
  • Renters are liable for damages, losses, or penalties (including traffic fines) incurred during the rental period.

4.6. Cancellations:

  • Owners and Renters may set and agree on cancellation terms, including possible penalties or forfeiture of deposits.
  • The Platform does not determine or guarantee refunds or compensation for cancellations.

4.7. By confirming a booking, the Renter acknowledges and agrees to the Owner’s rental terms, in addition to these Terms of Use.

 

5. Payments and Fees

5.1. Payment methods:

  • Payments on the Platform may be processed via third-party payment service providers (including but not limited to Stripe, LiqPay).
  • Owners and Renters may also agree to make payments in cash at the time of vehicle handover.
  • The Platform is not a payment operator and does not provide financial services; responsibility for payment processing lies with the third-party providers.

5.2. Service fees:

  • The Platform charges a service fee on each completed rental transaction, the amount of which is communicated to users before booking.
  • The service fee is deducted automatically when payment is processed through a third-party provider, or invoiced separately if the transaction is conducted in cash.
  • Service fees are non-refundable, unless explicitly stated otherwise by the Platform.

5.3. Rental price and deposits:

  • Rental prices, deposits, and cancellation penalties are set solely by the Owner and are displayed in the Listing.
  • The Platform does not determine or guarantee vehicle pricing, deposit amounts, or refund terms.
  • Owners may require a refundable deposit, which is handled either directly between the Owner and Renter or via the chosen payment method.

5.4. Taxes:

  • Owners are solely responsible for determining, collecting, reporting, and remitting any applicable taxes arising from vehicle rental income.
  • The Platform does not act as a tax agent and does not withhold or remit taxes on behalf of Owners.

5.5. Refunds and cancellations:

  • Refunds (if applicable) are subject to the cancellation terms set by the Owner.
  • The Platform does not guarantee refunds for cancellations or disputes between Owners and Renters.

5.6. By using the Platform, users acknowledge that all financial obligations under a rental agreement are between the Owner and the Renter, and the Platform’s role is limited to charging service fees for its technological services.

 

6. Rights and Obligations of the Parties

6.1. Owners (Vehicle Providers)

Rights:

  • To set rental prices, deposits, cancellation penalties, and other rental terms at their sole discretion.
  • To refuse a booking request if the Renter does not meet eligibility requirements.
  • To claim compensation for damages, unpaid amounts, or penalties incurred during the rental period.
  • To request that the Renter provide valid identification and driver’s license before handover.

Obligations:

  • To provide a vehicle that is roadworthy, legally compliant, and with all required documents (e.g., registration, inspection, insurance if applicable).
  • To disclose any known damages, defects, or restrictions to the Renter prior to the start of the rental.
  • To deliver the vehicle in a clean and safe condition.
  • To comply with applicable laws, including tax obligations on rental income.

6.2. Renters

Rights:

  • To receive the vehicle in the condition and with the specifications described in the Listing.
  • To use the vehicle for the agreed period and under the agreed terms.
  • To request disclosure of all known damages or defects before accepting the vehicle.

Obligations:

  • To use the vehicle in compliance with applicable laws, traffic regulations, and the Owner’s conditions.
  • To return the vehicle on time, in substantially the same condition (normal wear and tear excepted), and with agreed fuel and mileage levels.
  • To bear responsibility for damages, fines, or losses incurred during the rental period.
  • To pay rental fees, deposits, penalties, and any other amounts agreed with the Owner.

6.3. The Platform

Rights:

  • To charge service fees for transactions facilitated through the Platform.
  • To suspend or terminate user accounts in case of violation of these Terms, suspected fraud, or illegal activity.
  • To remove Listings that violate the Terms, applicable law, or third-party rights.

Obligations:

  • To provide a technological service enabling interaction between Owners and Renters.
  • To process payments through third-party providers or facilitate cash transactions by recording relevant commission charges.
  • To forward communications, claims, and disputes between Owners and Renters without acting as an arbitrator.
  • To maintain reasonable efforts to protect user data in accordance with the Privacy Policy.

 

7. Insurance and Liability

7.1. Insurance

  • The Platform does not provide, issue, or guarantee any insurance coverage for vehicles, Owners, or Renters.
  • Owners are solely responsible for ensuring that their vehicles are covered by legally required insurance (if applicable under local law) and for offering optional additional insurance at their discretion.
  • Renters are solely responsible for verifying whether insurance coverage is provided by the Owner or a third-party provider before entering into a rental agreement.
  • The Platform may facilitate connections with third-party insurance providers, but such services are provided under separate contracts between the user and the insurer.

7.2. Liability of Owners

  • Owners bear full responsibility for the condition, safety, and legal compliance of their vehicles.
  • Owners are liable for any damages, losses, or injuries arising from the use of their vehicles during the rental period, except where liability is expressly transferred to the Renter under the rental agreement.
  • Owners must indemnify and hold the Platform harmless from any claims, damages, or disputes related to their vehicles.

7.3. Liability of Renters

  • Renters are fully responsible for the use of the vehicle during the rental period, including compliance with traffic regulations and legal restrictions.
  • Renters shall bear financial responsibility for damages, accidents, theft, fines, or other liabilities occurring during the rental, unless otherwise covered by valid insurance.
  • Renters must indemnify and hold the Platform harmless from any claims, damages, or disputes arising from their use of the vehicle.

7.4. Liability of the Platform

  • The Platform acts solely as a technological intermediary and does not own, operate, control, or inspect any vehicles listed.
  • The Platform does not accept liability for:
    • the condition, safety, or legality of vehicles;
    • the accuracy of Listings or representations made by Owners or Renters;
    • any damages, injuries, losses, or disputes arising from rentals.
  • The Platform’s liability is strictly limited to providing the online service and collecting applicable service fees.

 

8. Payments and Fees

8.1. General Principles

  • The Platform is not a financial institution and does not provide payment services in its own name.
  • All payments related to rentals are made directly between Renters and Owners, either through integrated third-party payment processors (e.g., Stripe, LiqPay) or in cash, if permitted.
  • The Platform only facilitates payment processing through third-party providers and collects applicable service fees.

8.2. Service Fees

  • The Platform charges Owners and/or Renters a service fee for using the Platform.
  • The amount and structure of service fees are specified in the Platform’s pricing policy and may be updated from time to time.
  • Service fees are non-refundable, unless otherwise expressly stated by the Platform.

8.3. Third-Party Payment Processors

  • The Platform integrates with third-party payment providers to enable online payments.
  • By using such services, Users agree to the terms and conditions of the respective payment providers.
  • The Platform does not store Users’ financial data such as credit card numbers or bank account details.

8.4. Cash Payments

  • If cash payment is selected, the Renter pays the rental price directly to the Owner.
  • In such cases, the Owner remains responsible for paying applicable Platform service fees within the specified timeframe.
  • The Platform bears no responsibility for disputes or issues arising from cash payments.

8.5. Taxes

  • Owners are solely responsible for determining, collecting, reporting, and remitting applicable taxes, fees, or charges related to their rental activities.
  • The Platform does not provide tax advice and bears no responsibility for Users’ tax obligations.

 

9. Cancellations and Refunds

9.1. General Principles

  • The Platform is not a party to rental agreements and does not provide refunds on behalf of Owners or Renters.
  • Cancellation, refund, and penalty terms are determined solely by the Owner and must be clearly stated in the Vehicle Listing.
  • Renters are responsible for reviewing the applicable cancellation and refund policy before booking.

9.2. Owner’s Rights and Obligations

  • Owners may set cancellation deadlines, refund amounts, penalties for late cancellations, or non-refundable deposits.
  • Owners must ensure that their cancellation policies comply with applicable local laws and are transparently disclosed to Renters.
  • In case of Owner-initiated cancellations, the Owner is responsible for promptly refunding the Renter, if applicable.

9.3. Renter’s Rights and Obligations

  • Renters must comply with the cancellation terms set by the Owner.
  • If a Renter cancels a booking outside the allowed refund period, the Owner may retain all or part of the rental fee as a penalty.
  • Refund eligibility depends solely on the Owner’s stated policy.

9.4. Platform’s Role

  • The Platform may display and transmit the Owner’s cancellation and refund terms to Renters but does not establish or enforce them.
  • The Platform bears no responsibility for disputes related to cancellations or refunds.
  • In case of disputes, the Platform may facilitate communication but does not make binding decisions.

 

10. Dispute Resolution

10.1. General Principles

  • The Platform is not a party to rental agreements and does not act as an arbitrator or guarantor in disputes between Owners and Renters.
  • Any disagreements, claims, or demands arising from rental transactions must be resolved directly between the Owner and the Renter.

10.2. Role of the Platform

  • The Platform may provide a communication channel for the exchange of claims, explanations, or evidence between parties.
  • The Platform may assist in documenting and forwarding complaints but does not impose binding resolutions.
  • The Platform does not assume financial, legal, or technical responsibility for dispute outcomes.

10.3. Recommended Resolution Process

  • Parties are encouraged to first attempt an amicable settlement through direct communication.
  • If no agreement is reached, parties may use independent mediation, arbitration, or court proceedings under applicable law.
  • The jurisdiction and governing law applicable to disputes are determined by the agreement between the Owner and the Renter.

10.4. Limitation of Platform’s Involvement

  • The Platform shall not be liable for any damages, losses, or costs incurred by either party in connection with disputes.
  • The Platform’s customer support team is limited to facilitating communication and providing technical support related to the use of the Platform.

 

11. Termination and Suspension of Accounts

11.1. Right to Suspend or Terminate

  • The Platform reserves the right to suspend or terminate a User’s account at its sole discretion in cases of:
    • Violation of these Terms of Use or applicable law;
    • Providing false, misleading, or incomplete information during registration or use of the Platform;
    • Fraudulent, abusive, or harmful activity, including attempts to circumvent the Platform’s payment systems;
    • Repeated complaints from other Users regarding misconduct, non-performance, or breach of agreements.

11.2. User’s Right to Terminate

  • Users may request account termination at any time by following the procedures available in their account settings or by contacting customer support.
  • Termination of the account does not release Users from obligations already undertaken (e.g., ongoing rentals, pending payments).

11.3. Consequences of Suspension or Termination

  • Upon termination, the User’s access to the Platform and related services will be revoked.
  • Any active listings, reservations, or pending transactions may be canceled.
  • The Platform does not provide compensation for losses resulting from suspension or termination.

11.4. Preservation of Rights

  • The Platform may retain certain information related to terminated accounts for legal, regulatory, or security purposes.
  • The Platform’s rights to collect any outstanding fees or claims survive account termination.

 

12. Data Protection and Privacy

12.1. General Principles

  • The Platform respects the privacy of its Users and is committed to protecting their personal information in compliance with applicable data protection laws, including but not limited to the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA), where applicable.
  • By using the Platform, Users agree to the collection, processing, and storage of their data as described in this Privacy Policy.

12.2. Categories of Data Collected

The Platform may collect the following categories of information:

  • Account Information: name, email, phone number, password.
  • Identity Verification Data: driver’s license, ID/passport details (where required by law or for security purposes).
  • Transaction Data: payment details, billing information, rental history.
  • Technical Data: IP address, browser type, device information, cookies, and usage statistics.
  • Communication Data: messages exchanged via the Platform, support requests, dispute-related information.

12.3. Purposes of Data Processing

The Platform processes personal data for the following purposes:

  • Providing access to the Platform’s services and features;
  • Enabling secure transactions between Users;
  • Complying with legal and regulatory obligations;
  • Preventing fraud, abuse, and unauthorized use;
  • Improving Platform functionality, analytics, and customer support;
  • Providing marketing communications (with the User’s consent).

12.4. Data Sharing and Disclosure

  • The Platform does not sell personal data to third parties.
  • Data may be shared with:
    • Payment processors (e.g., Stripe, LiqPay) for secure transactions;
    • Insurance partners, if insurance is purchased via the Platform;
    • Regulatory authorities or law enforcement, where required by law;
    • Service providers assisting with hosting, analytics, and support.

12.5. Data Retention

  • Personal data is retained for as long as necessary to fulfill the purposes stated above or as required by law.
  • Users may request deletion of their data, subject to retention obligations (e.g., accounting, fraud prevention).

12.6. User Rights

Depending on jurisdiction, Users may have the following rights:

  • Access: request a copy of their personal data;
  • Correction: update or correct inaccurate information;
  • Deletion: request erasure of personal data (“right to be forgotten”);
  • Restriction: limit processing of their data;
  • Portability: receive a copy of their data in machine-readable format;
  • Opt-Out: decline marketing communications.

Requests can be submitted via the Platform’s support channels.

12.7. Data Security

  • The Platform implements reasonable technical and organizational measures to protect data against unauthorized access, alteration, disclosure, or destruction.
  • Despite these measures, no system can be guaranteed 100% secure, and Users acknowledge the inherent risks of transmitting data online.

12.8. International Transfers

  • Data may be processed and stored in jurisdictions outside the User’s country of residence.
  • Where required, safeguards such as Standard Contractual Clauses (SCCs) or equivalent mechanisms are applied.

12.9. Changes to Privacy Policy

  • The Platform reserves the right to update or amend this Privacy Policy at any time.
  • Continued use of the Platform after changes constitutes acceptance of the updated Privacy Policy.
